When someone buys a presale condo from a developer, they own the contract — not the unit itself, since it's not built yet. An assignment is when that original buyer sells their contract to a new buyer before the building completes.

You're essentially stepping into their spot. You inherit their purchase price, their suite, their floor, their finishes — and often at a better deal than what the developer is currently selling for.

Is buying a condo assignment legal in BC?+
Yes, condo assignments are completely legal in British Columbia. They are governed by the Real Estate Development Marketing Act (REDMA). The original buyer and new buyer both sign an assignment agreement, and the developer must typically approve the transfer. A real estate lawyer handles the formal paperwork at completion.
Do I pay GST on a condo assignment?+
GST applies to new construction, including assignments. You pay GST at completion based on the higher of the original purchase price or the assignment price. You may be eligible for the New Housing Rebate if the unit will be your primary residence. Speak with your accountant before finalizing an assignment purchase.
Does the developer have to approve the assignment?+
In most cases, yes. Most presale contracts require developer consent to assign, and developers typically charge an assignment fee (ranging from $500 to several thousand dollars). Some developers restrict assignments entirely. Your realtor will review the original contract and confirm whether assignment is permitted before you proceed.
Why are so many assignments listed on Facebook and WeChat instead of MLS?+
Assignments were historically harder to list on MLS due to FINTRAC and disclosure requirements, and many sellers prefer informal channels for speed and privacy. How is the assignment price determined?+
The seller sets the assignment price based on what they originally paid, what they need to recoup (deposits paid), and what the current market will bear. In strong markets, assignments can sell at a premium over the original price. In softer markets, sellers may accept at or below the original price just to exit. Every deal is negotiable.
