Privacy Policy

This policy explains what personal information vancouverdwelling.ca collects, why, who it goes to, and what you can do about it. It is written to be read, not to be skimmed past.

Who is responsible for your information

This website is operated by Jacky Ng, a licensed real estate advisor in British Columbia, under the brand Vancouver Dwelling and as part of the Vancity Experts team. Real estate services are provided through my brokerage, RE/MAX Crest Realty.

That split matters for privacy. Information you send through this website is handled by me. Once you become a client and a transaction begins, records are also held by the brokerage, which has its own obligations and its own privacy practices under the Real Estate Services Act. If your question concerns brokerage transaction records rather than this website, I will direct you to the brokerage’s privacy officer.

This policy is governed by British Columbia’s Personal Information Protection Act (PIPA), and where it applies, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

What I collect

Information you give me directly

The forms on this site collect different things depending on what they are for:

• VIP presale and newsletter forms: your name, email address, and what type of home you are looking for.
• Assignment buyer registration: your name, email address, preferred city or area, budget range, and number of bedrooms.
• Assignment listing submission: your name, email address, phone number, and details of the contract you want to assign: the development, approximate address, original purchase price, your asking price, deposit already paid, size, and estimated completion. This is the most sensitive form on the site because it contains financial information about you and about a specific property.
• Direct contact: anything you choose to tell me by email, phone, WhatsApp or WeChat.

You are never required to use a form. You can always call or email me instead.

Information collected automatically

• Server logs kept by the web host: IP address, browser type, pages requested, and timestamps.
• Cookies and similar technologies, described in the next section.
• Anti-spam signals: when you submit a form, the submission content, your IP address and browser details are checked against a spam-filtering service before the message reaches me.

What I do not collect

This site does not take payments and does not ask for financial account numbers, credit card details, social insurance numbers or government identification. Accounts and public registration are disabled: there is no visitor login. If a page ever asks you for any of that, it is not mine; close it and tell me.

Identity verification is a separate matter. If we proceed to a transaction, federal anti‑money‑laundering law requires the brokerage to verify your identity and record it. That happens through the brokerage, in person or through its own secure process, never through this website.

Cookies and tracking

Cookies are small files stored by your browser. This site uses them for four purposes:

• Essential: keeping the site working, remembering your language choice, and protecting forms from automated abuse.
• Spam protection: a filtering service sets cookies to distinguish people from bots.
• Marketing and analytics: I use HubSpot, a customer relationship platform, which sets cookies to recognise returning visitors, record which pages you viewed, and connect that activity to you if you later submit a form or reply to an email.
• Embedded content: pages that include YouTube videos, Instagram posts, or Google Maps load content from those companies, which may set their own cookies and see your IP address. Fonts are loaded from Google, which also receives your IP address.

This site does not use Google Analytics. You can block or delete cookies in your browser settings; essential cookies aside, the site will still work.

Why I collect it

Under PIPA I may only collect what a reasonable person would consider appropriate. I use your information to:

• answer your question and send you the presale, assignment or market information you asked for;
• understand what you are looking for so I do not waste your time on unsuitable projects;
• send you market updates and new project alerts, if you asked for them;
• meet my legal, regulatory and brokerage obligations.

I do not sell your personal information. I do not rent, trade or otherwise disclose it for anyone else’s marketing.

Who your information goes to

To run this website and my practice, I use service providers who process information on my behalf. They are not permitted to use it for their own purposes:

• GoDaddy: website hosting and server logs.
• HubSpot: customer relationship management, website visitor tracking, and email.
• CleanTalk: spam filtering of form submissions.
• Brevo (formerly Sendinblue): delivery of form notifications, replies and newsletters.
• Google, YouTube, Instagram and WhatsApp, where you use those features or view embedded content.

Beyond service providers, your information may be disclosed to:

• My brokerage, RE/MAX Crest Realty, where you become a client, brokerages are required to hold transaction records.
• Developers and their sales teams, but only with your knowledge, and only when you ask to be registered for a specific project. Registering you with a developer means giving them your name and contact details. I will tell you before I do it.
• Regulators, law enforcement or courts, where the law requires it, including BCFSA and FINTRAC.

Information stored outside Canada

Some of these providers store or process information on servers outside British Columbia, including in the United States, and in the European Union in the case of Brevo. Information held in another country may be accessible to that country’s courts and law enforcement under its laws. If you would rather not have your information handled that way, contact me by phone instead of using a form and tell me so.

Marketing emails

I only send market updates and project alerts to people who asked for them. Canada’s anti-spam legislation gives you the right to withdraw that consent at any time, and every message I send includes an unsubscribe link. Unsubscribing stops the marketing; it does not stop me replying to a question you asked, and it does not delete your record if I am required to keep it.

How long I keep it

• Enquiries that do not become a client relationship, kept while there is a realistic prospect of being useful to you, then deleted on request or during periodic review.
• Marketing subscribers: kept until you unsubscribe, plus a short period to honour the unsubscribe.
• Client and transaction records: held by the brokerage for at least seven years after creation, as required by the Real Estate Services Act rules.
• Identity verification records under federal anti‑money‑laundering law, retained for five years after the last transaction.

Where a retention period is set by law, I cannot delete the record early, even at your request.

Your rights

Under PIPA you have the right to:

• Ask what I hold about you and how it has been used or disclosed. I will respond within 30 business days.
• Correct anything inaccurate.
• Withdraw your consent at any time, subject to legal or contractual limits. I will tell you what withdrawing would mean before it takes effect.
• Ask me to delete information I am not required to keep.
• Complain if you think I have got it wrong.

To exercise any of these, email ja***@************ts.com. There is no charge for a reasonable request. I may need to confirm your identity first, so that I am not disclosing your information to someone else.

Security

The site is served over an encrypted connection, form submissions are filtered for abuse, and access to the systems holding your information is restricted and password‑protected. No website can promise perfect security, and I will not pretend otherwise. Please do not send financial account details, identification documents or anything else highly sensitive through a web form or ordinary email, call me and we will find a safer route.

Children

This site is meant for adults buying and selling real estate. I do not knowingly collect information from children. If you believe a child has submitted information, tell me and I will delete it.

Changes to this policy

If this policy changes materially, I will update the date at the top and, where the change affects how I use information you already gave me, tell the people affected.

Complaints

If you are unhappy with how your information has been handled, contact me first, most problems are a misunderstanding and can be fixed quickly. If you are not satisfied with my answer, you can complain to the Office of the Information and Privacy Commissioner for British Columbia, which oversees PIPA. Complaints about the conduct of a real estate professional can be made to the BC Financial Services Authority.
